CHITTI PLATFORM: MASTER TERMS OF SERVICE, USER AGREEMENT, AND PRIVACY POLICY

Chitti operates strictly as an "Intermediary" as defined under Section 2(1)(w) of the Information Technology Act, 2000 (and its subsequent amendments). The Platform is an online technology marketplace that aggregates, matches, and connects independent Service Providers (such as plumbers, electricians, technicians, local vendors, etc.) with independent consumer end-users ("Users").

Chitti does not provide, execute, or perform any physical services, technical services, or manual labor itself. Chitti does not employ, hire, or manage Service Providers. No employer-employee, agency, partnership, joint venture, or franchise relationship exists between Chitti and any Service Provider or User.

The trademark "Chitti", the chitti.online domain name, the Chitti application icon, logos, brand colors, layout designs, user interfaces, matching algorithms, source code, object code, databases, trade secrets, and the specific title/concept "World’s First Intelligent Service Category" are the sole and exclusive intellectual property of Chitti.

The Platform is protected by the Trademarks Act, 1999, the Copyright Act, 1957, and the Patents Act, 1970 of India, as well as international intellectual property treaties.

Any attempt by a competitor, user, provider, or third party to copy, reproduce, modify, distribute, scrape, mimic, or reverse-engineer Chitti's features, visual layout, intelligent categorization, or structural workflows is strictly prohibited. Chitti reserves the right to initiate criminal prosecution and file for immediate civil injunctions and punitive damages up to the maximum financial limit permitted by law against anyone found copying or stealing Chitti’s operational models, code, or branding.

Chitti makes no express or implied warranties, guarantees, or representations regarding the safety, reliability, capability, licensing, quality, legality, or behavior of any Service Provider.

While Chitti may perform baseline identity checks, the verification of a provider's profile does not equal an endorsement. The User is solely responsible for exercising caution and inspecting the credentials of any Service Provider entering their home or commercial space.

Under no circumstances shall Chitti be held civilly or criminally liable for any property damage, bodily injury, financial loss, theft, delayed performance, unsatisfactory work, or death resulting directly or indirectly from a transaction or interaction arranged via the Platform. All engagements between a User and a Service Provider are completely independent contracts executed at the parties' own risk.

Users agree to provide 100% accurate, up-to-date, and honest data when creating an account or booking a service. Creating fake accounts or submitting fraudulent service requests to manipulate platform dynamics is a breach of contract.

Users shall not use the Platform to harass, abuse, stalk, threaten, or insult any Service Provider or Chitti employee.

Service Providers explicitly declare and acknowledge that they are independent business entities. They are entirely responsible for securing their own tools, vehicles, insurance, professional certifications, and licensing required to operate their respective trade.

Service Providers are solely liable for tracking, filing, and paying all applicable local, state, and central taxes (including Goods and Services Tax, if applicable) arising from income earned through platform connections.

Service Providers are strictly forbidden from inducing, encouraging, or convincing a User introduced via Chitti to take transactions "off-platform" or pay them directly in cash to bypass Chitti’s platform commission or lead fees.

If a Service Provider is discovered bypassing the Chitti ecosystem to provide services directly to an introduced User, Chitti reserves the right to permanently terminate the Provider's access without notice and collect a contractual penalty fine of ₹50,000 or three times (3x) the projected annual transaction value of that customer relationship, whichever is higher, in a court of law.

Service Providers must maintain high professional standards. Any instance of theft, physical assault, verbal abuse, property destruction, intoxication on the job, or sexual harassment will result in:

• Immediate, irreversible deactivation and deletion of their Chitti account.
• Complete forfeiture of any pending or escrowed account balances.
• Direct transmittal of all identification documentation and GPS telemetry logs to law enforcement authorities in Jangareddigudem.
• Filing of civil claims by Chitti against the provider for malicious damage to the Company’s brand reputation.

Chitti may display third-party advertisements on the Platform. Chitti does not endorse, vet, or guarantee the claims, products, qualities, or services advertised.

Any financial transaction, click-through, or purchase made by a User on an advertiser's platform is an independent transaction between that user and the advertiser. Chitti is completely exempt from liability for any scam, defective product, or misleading claim originating from an advertisement hosted on the app.

Chitti operates in strict compliance with the Digital Personal Data Protection (DPDP) Act, 2023 and the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011.

To ensure the proper functioning of our "Intelligent Service Category" model, Chitti collects and processes:

• Identity Information: Name, phone number, physical address, and verification IDs (for providers).
• Telemetry and Location: Precise GPS data (background and foreground) to map real-time provider and user proximities.
• Device Logs: Device identifiers, IP addresses, operating system data, and app crashes/metrics.
• Transaction Records: History of services requested, fulfilled, and payment/token settlement markers.

All collected data is used exclusively to facilitate automated connections, secure the physical safety of users and providers, analyze platform performance, prevent fraud, and comply with law enforcement requirements.

Chitti maintains reasonable security measures to safeguard data against breach, loss, or unauthorized access. All user data is processed and localized on secure cloud infrastructure located within the geographical boundaries of the Republic of India.

Users have the right to request the deletion of their personal accounts and historical details by contacting user support inside the application. Chitti will wipe the data within statutory timelines, except for data that must be legally retained to fulfill active tax, accounting, or ongoing law enforcement investigations.

To the maximum extent permitted under applicable law, Chitti, its directors, officers, shareholders, and employees shall not be liable for any indirect, incidental, special, exemplary, punitive, or consequential damages—including loss of profits, data, goodwill, or service interruption—arising out of or in connection with the Platform.

If a court of competent jurisdiction finds Chitti liable for any claim despite the waivers inside this agreement, the total aggregate liability of Chitti to any party (User, Service Provider, or Advertiser) for all damages, losses, and causes of action shall be strictly capped and limited to a maximum total sum of ₹5,000 (Rupees Five Thousand Only) or the exact amount of fees/commissions pocketed by Chitti from that specific transaction, whichever is lower.

You agree to fully indemnify, defend, protect, and hold harmless Chitti and its executive team from any and all third-party legal claims, losses, costs, regulatory penalties, damages, or legal expenses (including high-court advocate fees) resulting from your violation of these Terms, your misuse of the Platform, or your infringement of any intellectual property rights.

This Master Agreement, along with all operational policies, shall be exclusively governed by, interpreted, and construed in accordance with the substantive laws of the Republic of India.

Any dispute, lawsuit, arbitration, legal controversy, civil complaint, consumer court filing, or criminal cross-complaint arising out of or related to Chitti’s business, operations, or technology platform shall be brought exclusively before the competent courts sitting in Jangareddigudem, Andhra Pradesh, India.

All users, providers, advertisers, and corporate stakeholders reading these terms hereby irrevocably submit to the personal venue of the courts in Jangareddigudem, and expressly waive any rights to claim that such courts constitute an inconvenient, remote, or improper legal forum.

If any single section, paragraph, or clause of this Agreement is declared invalid or unenforceable by an official court order, that specific part will be modified to reflect the parties' original intent, and all remaining sections of this Agreement will remain in full force and effect.

Any failure by Chitti to strictly enforce a clause or delay taking legal action against a breach does not constitute a waiver of Chitti's rights to enforce those exact terms in the future.

By checking the box next to "I agree to the Master Terms of Service and Privacy Policy," you explicitly execute an electronic contract. You acknowledge that this action satisfies all legal requirements for written signatures under the Information Technology Act, 2000, creating an ironclad, binding obligation.
